These Terms of Use (“Terms”) govern your use of this website and the OutliveMe Services provided by OutliveMe Management, LLC (“OutliveMe,” “we,” “us”). By using the Services, you agree to these Terms.
1. Not a medical emergency service
OutliveMe is not for medical emergencies. If you are experiencing a medical emergency, call 911 or your local emergency number, or go to the nearest emergency room. The Services do not replace urgent or emergency care.
2. The Services
OutliveMe is a clinician-led performance health practice. Clinical care is provided by licensed members of your care team. Any information delivered through the Services is for your care and general information; it is reviewed by a clinician before it reaches you and does not establish a provider relationship until you have enrolled and completed the required steps.
3. Eligibility and accounts
You must be at least 18 years old to use the Services. You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. Notify us promptly of any unauthorized use of your account.
4. Communications consent
By providing your contact information, you agree that we may communicate with you by email and, where you opt in, by SMS, as described in our Privacy Policy and SMS Terms. You may opt out of non-essential communications as described there.
5. Acceptable use
You agree not to misuse the Services, including by attempting to access accounts or data that are not yours, interfering with the operation of the Services, or using them for any unlawful purpose.
6. Intellectual property
The Services, including all content, branding, and software, are owned by OutliveMe or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Services for their intended purpose.
7. Payment
Membership fees, billing cadence, and cancellation terms are described at enrollment. Where you purchase a membership, you authorize us to charge the payment method you provide on the terms presented to you.
8. Disclaimers
Except as required by law, and except for the professional clinical care provided by your licensed care team, the website and software are provided “as is” without warranties of any kind. We do not warrant that the Services will be uninterrupted or error-free.
9. Limitation of liability
To the fullest extent permitted by law, OutliveMe will not be liable for indirect, incidental, special, or consequential damages arising from your use of the website or software. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability relating to professional medical care.
10. Changes to these Terms
We may update these Terms from time to time. The current version will be posted here with an updated date. Continued use of the Services after changes take effect constitutes acceptance.
11. Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-laws rules.
